WHAT IS THE DIFFERENCE BETWEEN PROBATE AND ADMINISTRATION?
When someone passes away with a Will in place, probate is the process of filing the Will in probate court in order to have the Executor named in the Will officially appointed.
When someone passes away without a Will in place, then the process can become a little more complicated. An Administrator will need to be appointed in accordance with the law and surrogate’s court procedure.
